Both my wife and I are working on H1B visa.

We are landing in Canada for H1B visa renewal.

However, the nvars.com appointment system allows 1 primary applicatnt and then allows to add dependents to that application. Should I add my wife as a dependent or create an independent primary applicant profile for her since she would be requesting an H1 B renewal as well.

If I create an independent primary applicant profile for her, I may not be able to get the same visa date / appointment for both of us.

    Please guide.

    Thanks

I was in H1B visa(expires on Feb 2011). I got laid off from Employer_A from March 2009 and I transfered my I-797 to Employer_B in march 2009 itself through premium processing. It got approved and I have original approval notice also which expires on March 2012.

Now Employer_A likes to re-hire me back. I am also interested to go back. Do I need to transfer again from Employer_B to Employer_A?

Can I work for Employer_A with old I-797(expires on Feb 2011) ? I don't think Employer_A canceled or revoked my I-797 after they laid off.

You can get reimbursement for all eligible expenses but you will not get the tax benefit. The taxes due on that amount will be accounted for at the time of filing your return. You can submit claims and get them reimbursed.

    Hi:
My full 6 years of H-1B expires in Jan 2010. My labor will be filed in Jan 2009. I would like to go back to school full time on F-1 in Fall 09. At that time, I would still have 5 months of H-1B time remaining plus a priority date. After I graduate, find a job on a new OPT, would it be enough time to start a new GC processing, without having to go back home for a year?
    Thanks so much
    Debbie

Interesting study. The headlines this morning around the country are on the subset of children of illegally present parents which Pew is estimating is about 7% of all children born in the US. It's not a surprise to see the GOP getting increasingly crazy as they know that in the long run they'll go the way of the Whigs unless they either convince Hispanic voters to support them or disenfranchise enough of them that they can continue to win elections with only Anglo voters.

    Hi All ,

First of all , thanks soooo much for this great site. I have a small question. My PD is July 2002 under EB2 / India. I was stuck with name check. Now that name check does not matter because of new rule > 180 days and my PD becomes current from today - April 1 , how long does USCIS take to make a decision about my case ? Do I need to call them and request a case review or do something to see some movement ? Kindly advice. Or is it just wait ?

    Sincerely , MHK

My friend Tom Roach in Washington State forwarded this letter from the Arizona Catholic Conference which was released after Judge Bolton's decision in the Arizona case. I'm posting it because it has some language that I think is very helpful in the debate. The Bishops say There must be a process - but not amnesty - for persons who have entered our country illegally to pursue legal status. This process must have proportionate consequences for the act of illegal entry, consequences that would include fines, learning English, and going to the "back of the line" to seek citizenship. The idea...

    hi attorneys,

my H-1B petition is valid for another 3 months. we applied for my H1 extn and my spouse H4 extn 2 months ago. both r still pending.

my spouse H4 petition expired last month. since we applied extn b4 it expired, my spouse can stay in usa legally.

now my spouse wants to travel abroad for a family function.

    questions:
    (1) is it fine to travel abroad with H4 extn pending? (pls note that the H-1B holder will not be traveling)

    (2) if H4 extn is approved with new I-94 when abroad and my spouse gets another new I-94 at POE when returning, then which I-94 will be the latest valid one?

    thx in advance,

You can write (c) (09) or (c) (9). Hope this helps.

What should be filled for question 16 in I765 form.
My lawyer asked me to fill C C 9, but the instruction says C 9. Which is correct.

    hi,
I am unmarried son of citizens of usa and have my priority date current.I filed for I485 adjustment of status to permanent resident, which earlier got rejected, but then on refiling,I got a MSC receipt number saying next process is biometrics
My question is that as I am presently on student visa and my classes are starting from august 17th.Do I still need to maintain my student visa status and enroll in 12 minimum units,or is it ok If I don't enroll and just wait for my further case processing, and I won't be considered out of status as my I-485 adjustment of status is being processed? Is there still chance of my I-485 being denied(I don't have any criminal or any wrong record and maintained my status prior to filing my I-485 adjustment of status). Please guide whether to still enroll in 12 units and be on student visa or is it ok if I don't enroll as I no more want to pay high fees but,am worried about maintaining my status.

From the Miami Herald: Huge surges among Hispanic populations in the Deep South could mean a political sea change over the next two decades, as immigrants become naturalized and they and their American-born children register to vote, political and demographics experts say. The states with some of the largest percentages in Hispanic population growth make up a large swath of the Southeast: Alabama, Arkansas, Kentucky, Mississippi, North Carolina, South Carolina and Tennessee, according to an analysis of the most recent census figures by the Pew Hispanic Center. In all those Republican-dominated states, the percentage of Hispanics nearly doubled. Given the...

My PERM case has been pending for almost 15 months (under audit for 12 months). I asked my attorney about this enquiry thing that you can file to DOL after pending for 15 months (according to this thread (http://immigrationvoice.org/forum/showthread.php?t=21183&page=2)). Her response is that she has been sending requests about case status to the DOL on a regular basis.

Can anyone who's familiar with the matter tell me what's this enquiry is about? Is it just a regular status check or a more formal and serious matter that DOL has to assign a freaking living human to look at your case to reply?
