Nina Bernstein, one of the country's best immigration reporters, has a front page story in this morning's Times regarding 30 survivors of the January Haiti earthquake who were airlifted by Marines to the United States and are now sitting in detentions centers in Florida. According to the Times, these individuals were pulled from the rubble and were seeking food, safety or medical care at the airport in Port-au-Prince. Giving I-485 benefits to people without current PDs is a bad idea.
so what 's good idea to you......putting all of EB applicants who are waiting to file 485 in waiting state until you get your GC is a good idea?
First of all, why are you being worried about this action item being EB1 applicant and you will get your GC in no time...
I don't think you are from EB1 category...You are selfish mind who holds EAD and doesn't want other EB applicants to come in to 485 waiting line.
would you have had the same thought if there was no July 07 fiasco and if you would need to wait in the line........selfish minds like you can't stop this action item.

I would like to know can i change employer after my i-140 got approved.My i-140 got approved 6 months back and i have h1 until next year
You can shift to new employer and start the GC process again. The approved I-140 is useful to retain the PD if not revoked. Otherwise no use.

I had a 221g in 2000 and submitted all the docs. I got response in 2002 (After 2 years :eek:) . I had just 10 months left on my H1 that time. So we will never know. But situation in 2000 was different. I am not discouraging you but telling how hard these 221gs will be. I hope its not that bad these days and you may get response soon.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

yes. ur 140 is still valid. you don't need paystubs from company A, but its better to be working for company A the time you are filing 485 with them to make your case more authentic.

Experts,
I am planning to use AC21 and start a new job on EAD, although the reason I am telling my present employer is that I am going to home country and may or may notcome back. what happens if the employer revokes the H1B or can he ask uscis to stop all the immigration matters with me. I have finished 180 days hatch period ...:)

No, you don't need the I-864. The interview letter that you got might refer to an I-864, but this is often because the local district office has standard interview letters and they are more often for family cases than employment cases. I've seen this happen often.

An employer did H1 processing for Ms.A on US Masters degree quota in 2007, but she decided to go back to school before the H1 kicked in (communicated the same with H1 sponsor/Employer) and is getting the degree (PhD Engg) in Aug 2010. Ms. A never worked on H1 and continued to be a full time student(made the mistake of telling the university about H1).
FYI: Ms. A traveled to home country and got back on F1 visa in Aug 2007
What solutions does she have now?
1. Get a job, continue on H1 and extend it?
2. Get back to F1 ( graduate in December instead of Aug. Really difficult to find other schools giving I 20 now!)
(Ms.A may have to visit home country this year for personal reasons and visa stamping is required to get back to US!!!)
Is there any other solution?
Do you think consulting two different lawyers is helpful in this situation?
How much may be the Attorney fee ?
Deeply appreciate your input.

This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

Hi Gurus,
If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
My questions:
1. Can I take Infopass appointment anywhere else which is not my local office?
2. Can I apply a new 131 application at TSC as my 485 is there now?
Someone pls advise.

No where on the form we indicate that this is a RENEWAL??
