I have B1/B2 Visa for 10 yrs and travelled to USA earlier and also planning to VISIT USA on B1/B2 Visa in the last week of July for just 10 days.
The doubt is that - "since I have H1B Visa CASE APPROVAL, can I travel to USA on B1/B2 Visa"
Someone suggested that I can travel but it is NOT ADVISABLE!!

Hi
I have applied for cos from h1 to h4.
it is still pending. Am I eligible to renew my drivers license in PA based on pending cos to h4 receipt notice.
Any links or ideas are highly appreciated.

One of my friend who is an accountant's H1 visa was sponsopred by a non-accounting firm who needed an accountant who is familiar with accounting pratices here is USA and India. Now that the firm who initially hired him and sponsored his visa doesn't have a full time accountant requirement and he is finding it difficult to find an accounting firm to sponsor his visa. But the firm who originally hired him is willing and has an opening to place him in an accounting firm as accountant. But since the firm who originally hired him is not an accounting firm is there any legal issue in doing so. If it is legal, what should the either of the firms and/or he should do as far as paperworks are concerned.

The U.S. Department of State (DOS) reports that no later than April 30, 2010, all non-immigrant visa applicants worldwide will be required to use web-based form DS-160. The DS-160 form will combine the previous forms DS-156 and DS-157 and 158. Since not all U.S. Embassy’s and U.S. Consulates have implemented form DS-160, all consular posts that are not currently utilizing the DS-160 Web-based form will eventually be instructed to implement the DS-160 between March 1, and April 30, 2010. Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?
Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!

EB3 India is U for both August and Sep. How is USCIS still processing and approving GCs? Have they still not recovered from the madness of approving GCs?
Who knows, some July 2 Texas filers might get GCs in Sep.

Hi,
I have applied for H1B extension for 3 years based on my I 140 approval. I have submitted all relevant documentation except for client letter.
My current H1 expires in Oct and we are expecting our baby in October as well. I would like to know what would be my options in case my H1 extension in denied. I cannot leave with the new born atleast untill december (need time to get passport n visa for the baby) and I wouldn't want to get into any legal issues like staying in US n not being in status.
Looking forward to your advice and suggestions

I am US citizen since March 2009. Husband just received an interview notice for August 11 after having filed all required documents and application for I-485 adjustmnent of status. Along with other documents, we submitted a xerox copy of his I-94 which he overstayed. Unfortunately, he lost the original. My concern is, the interview notice states he is to bring the original I-94, which he no longer has. He can prove however the date of his last entry to the US, as he still has a stamp in his passport with admission date, a sticker on his passport cover for baggage and I can probably dig up his boarding pass. Again - we also made a xerox copy of both sides of I-94 when we still had it. What do I do? Should I get a duplicate? Or is the xerox enough for the interview? I would hate his application to be denied because of this. Please let me know if you had a similar experience or any advice on what I should do.

As long as the job responsibilities and duties match with what you are already performing, it is 100% safe to switch jobs . I had the same issue last year and I spoke with an attorney at Murthy law firm and based on which I started working with the new company. I did inform USCIS and everthing is working well so far.

during stage 3, they require a birth certificate. what if I dont have a birth certificate? do they accept an affidavit from my parents with a domicile cerrtificate or not? i dont even have a school leaving certificate. please give me advices.

Hello,
I have a h1b visa that will expire in March 2010. This visa has been already renewed for its second time so, as you know, I wont be able to renew it once again.
Currently I am applying for permanent residency ( EB3 category) and I am in the AOS phase. I have the possibility of renewing EAD's every year, but I need to understand what is going to happen when the H1b expires. Can I renew EAD's even after the visa is no longer valid? How does it work?
