I guess no complications unless USCIS asks for employment verification at the time of approving the case. He should continue to file for Income tax retrun for 2010 and also need to work for few months in 2011 to file for return.

Hello,
I have this situation and need some advice or if anyone can share their experiences.
H1b extension was denied with reason of "Employer-employee relationship". RFE was responded to (with requested pay stubs and W-2) and was still denied. Now, attorney from company is filing for MTR. How long does MTR processing take as the case was already existing? Does that matter or it doesn't? How long did it take to get a decision from CIS?
Is it possible to file MTR from company A (employer) and to file a new petition from company B (middle vendor who has direct contract with client)? Can the MTR be withdrawn in favor of a new petition?
Did anyone go for MTR and how many days did it take to get the decision?

I currently have a green card and I am filing a I130.
On part B question 14, (Date and place of admission for or adjustment to lawful permanent residence and class of admission), what is the correct way to answer "place of admission for or adjustment to lawful permanent residence"?
I received my employment based green card after filing I-485 and adjusting status. My AOS was approved while I was here in the US.

Hi,
I got a RFE while doing my H1B transfer under premium processing. They have stated to respond within 60 days. Does anybody have an idea as to whether it takes so long or it gets resolved soon under premium processing? Please help.
Once they recieve the response, if they are satisfied, the same day they will approve. It will not take that long depending on the type of RFE.

Thanks for your reply. I was off for a month and a half to complete a paper for my Masters and have proof for the same...I was not able to juggle both work and studies....will USCIS consider this excuse to be at home studying without pay?

1) I am in USA on H1B.
2) I have accepted an offer to join companyA in January '07. They have filed for the H1B transfer a few days back. And I have resigned from my current employer.
3) Now another companyB has agreed to acquire companyA, and they will close the deal in December '06. CompanyB will be issuing revised offer letters to new hires like myself soon.
So even when my H1B has been filed by CompanyA, it will cease to exist on my joining date (January '07).
My question is how is the H1B handled in such a case ?
Can an amendment be sent to the original application saying its for CompanyB, and not CompanyA. Or does CompanyB have to apply for a fresh H1B ?
General qn : When can I change the employer -- when the H1 papers reach INS or when the lawyers get the receipt notice from INS ?
They are setting up conference calls with the lawyers soon; I was wondering if I could get some inputs from the experts on the forum as well.

You know CIS may issue an RFE at any point in the AOS stage..wait and see what the RFE about and respond it accordingly...I think if you are going thru an Attorney he will receive the RFE letter followup with him..

ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. Great news! The Hatch widows bill (which removes the requirement that a couple must have been married for two years before a US citizen dies) passed and included in that bill were provisions extending the religious worker green card program and the Conrad 30 J-1 physician waiver program. Each of these programs were extended for three years. The EB-5 regional center program for immigrant investors was permanently reauthorized by the Senate yesterday. The House must agree to these amendments before they go to the President and I do not yet know whether the bill will go back to the House...
