Hello All,
I recently filed a labor and got A# and would like to know the options to check the status.
My employer is not willing to give the user id and password of the secured sire through which they filed the labor.
I would greatly appreciate your input.

Status of PERM can only be checked by your employer (with their user id and password of the secured site). Unfortunately there is no other way to check the status.

If your company is having layoff they cannot start new GC labour. But it has nothing to do with 485. And as in your case it doesn't stop the processing.;)

We have been applying for advance parole document at NSC for the last few years.
This time we sent our application to NSC on 01/28/2010.
After about 15 days, we received a receipt notice letter from Vermont service center.
The I-131 application instructions specify that I-140 based applications should be sent to either Nebraska or Texas service centers.
I am wondering if USCIS started processing I-131 application in VSC.
Or our application is mistakenly misclassified and sent to VSC.
Any comments?

I was searching on all programmer salary's on SalaryList.com (http://salarylist.com), it looks like we are much higher than the other majors, business analyst, finance analyst. So if I want to do AC21, in current condition, should I keep same salary? Several companies I talk to can only match now

My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.
1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.
2 ) Are there any chances of rejection
3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.
4) Can we expect some decision from them this week as client is waiting.
5) At what time CSC updates the case. Is there any particular time they update the case online.

My company is filing 140 and 485 on a preapproved LC (PD of 2005)
But my original LC in P-BEC just got cleared (PD of 2003). They told that they will also use my original LC for 140 as this gives better chance than the substituted one.
1)How Can I have 2 140's ?
3)How will it effect 485?

Comp A (A Consulting Firm)applied for H1-B in April 2009 thru consular Processing and got approved. I worked for Client X in the month of April but lost my job in a week itself.(thus I dont have any pay Stubs from Comp A)Since Comp A was not able to find me a job. I found A full time job in Comp B in June 2009 , I somehow convinced Comp B to hire me as a contractor as I already have my H1-B approved thru Comp A. Thus from july 2010 I started working for Comp A again as my employer and Comp B as its Client. I am planning to go for VISA stamping in Dec 2010. My Question is
1) If they Ask for my Tax Returns and W2 for 2009 what should I answer as I just have my W2 frm Comp B
2) would there be a question of something like why havent I've been working for Comp A Since my H1 approval.
Please advice. I appreciate any kind of answer

I got my 140 approved.Is there any deadline date like with in 90 days i have to apply for 485 or else it will expire.I am single so i dont want to get in to any trouble by applying for 485.

Here is my situation, I will file for I-485 on July 1st.....but on July 21 I have to leave U.S....and my question is:
Can you leave the country as soon as you filed for I-485? or you have to wait for I-485 reciept?...I know it's mandatory to stay in U.S at the time of filing for I-485.....And is it true that after you file for I-485 you can leave U.S without any problems?

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping right after his L1B stamping, will it affect the visa officer's decision in issuing a H1 visa?
Last question: he has already spent 3 years in the US on a L1B visa. So, if he comes here on a H1B visa, will the 6-year term limit count his 3 yr. stay on L1 visa or will a new clock start when he enters on H1?
Please chime in if anyone has done this before or has any insight on this matter.

ICE has announced sentencing in two cases related to visa fraud. Houston immigration lawyer Kenneth Rothey has been sentenced to fourteen months in prison for money laundering and visa fraud. Rothey was convicted for his role in securing L-1 visas based on manufactured corporate relationships. ICE also announced the sentencing of Kwan Tsoi to nineteen months in prison for her role in arranging fraudulent marriages and then submitting immigration applications based on the marriages.
