Hi,
I got my H1b approved this year. My first name is set to FNU and my full name was added in last name. Now i have got it corrected in my passport as it was wrong in the first place. After my passport was corrected, I was advised to apply for H1B amendment. I have applied for H1B amendment in November. Also I was unable to get my SSN bcos of this name issue and SSN office is demanding to get I797 corrected before issuing the SSN. Now since I am waiting for my SSN and H1B amanedment. I am not paid. I want to know if I am still legal and I am in status? Please let me know the process I should follow if there are any?
This is extremely urgent and any help/advice in thsi regard wil lbe great.

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

I could not find my old EAD card either, but my lawyer said it was OK to file for EAD without the old EAD card.

My company got one previous LC approved whose requirements are BS in CS or Engg related. I have a civil engg degree, I would like to file I140 and get old PD. Will this substitution work? If anyone with "non CS" engg degree used a labor that asked degree in "CS or Engg rel" in item 14 on 750A please share your response.

Interim EAD's are no longer an option since Sep 2006
In case of emergency travel it is possible to get AP from local office
But in case of extreme emergency like death in the family, funeral etc

Hi All,
I have applied for H1b to F1 visa transfer with an i-20 from a university for the Spring of 2010.
Now, I received an admission from a better university for the same term (Spirng 2010) and I wish to join the Second University.
Could you please tell me the procedure to join second university.
1. Can I let the H1-F1 visa transfe (first university) go through and then apply for change of university or something ? If so, can some one outline the procedure for transfer of university (I am worried about the time it takes for the transfer of university for me to join for Spring 2010).
2. Is it possible to change the transfer application with i-20 and appropriate financial documentation ?

One explanation for all this is that politicians are acting against the will of their compromise-loving constituents. Another is that Republicans and Democrats are simply being good representatives. We think the evidence supports the second interpretation.
The Cooperative Congressional Election Study (CCES) surveyed more than 24,000 Americans who voted in 2006. The Internet-based survey compiled by researchers at 30 universities produced a sample that almost perfectly matched the national House election results: 54 percent of the respondents reported voting for a Democrat, while 46 percent said they voted for a Republican. The demographic characteristics of the voters surveyed also closely matched those in the 2006 national exit poll. If anything, the CCES respondents claimed they were more "independent" than those in the exit poll.
The CCES survey asked about 14 national issues: the war in Iraq (the invasion and the troops), abortion (and partial birth abortion), stem cell research, global warming, health insurance, immigration, the minimum wage, liberalism and conservatism, same-sex marriage, privatizing Social Security, affirmative action, and capital gains taxes. Not surprisingly, some of the largest differences between Democrats and Republicans were over the Iraq war. Fully 85 percent of those who voted for Democratic House candidates felt that it had been a mistake to invade Iraq, compared with only 18 percent of voters who cast ballots for Republicans.
When we combined voters' answers to the 14 issue questions to form a liberal-conservative scale (answers were divided into five equivalent categories based on overall liberalism vs. conservatism), 86 percent of Democratic voters were on the liberal side of the scale while 80 percent of Republican voters were on the conservative side. Only 10 percent of all voters were in the center. The visual representation of the nation's voters isn't a nicely shaped bell, with most voters in the moderate middle. It's a sharp V.
The evidence from this survey isn't surprising; nor are the findings new. For the past three decades, the major parties and the electorate have grown more divided -- in what they think, where they live and how they vote. It may be comforting to believe our problems could be solved if only those vile politicians in Washington would learn to get along. The source of the country's division, however, is nestled much closer to home.

Hi,
I am on H1b visa and it is expiring on Sep 2010. I heard that we need to apply for renewal 3 months before the expiry date,(i.e,June). I am planning to transfer my H1 to another employer. If I do so, will my H1 be automatically renewed during the transfer process? Also, If I transfer my H1 and go out of the country, do I need to get my visa stamping re-done when I come back to the country...

Hello,
I am changing my employer with whom I had a H1-B (extended beyond 6 years) and with the new employer I will be starting on EAD (which I have from my wife's GC application). I have couple of questions.
- Once I start using EAD and if I travel out of US and intend to use AP for re-entry, are there any issues travelling to European countries? I have heard there are problems getting transit visas when on AP. Is this true or is it just for particular airlines?
- Once I start using EAD, can the new employer apply for H1-B visa transfer or a new H1-B after I start using EAD or its not possible.

Who is the best immigration attorney out there to deal with a cross-chargeability case? (Need to claim cross-chargeability based on Spouse's citizenship on an already filed I-485 case).

You need to file I-824 to get a duplicate I-797
