Is it possible to upgrade a pending I-485 (EB3 I-140) with a newly approved EB2 I-140?
Is there any USCIS mandated procedure to do that?
I think it will be taken care automatically, ( since your A number on I 485 and new I 140 will be the same )
Thanks

You should be fine. If you I-140 is not approved by 2008, you can apply for a 1 year extension based on the fact you have an approved labor. Otherwise you would get a 3 year extension.

In short, the E-Verify federal contractor rule lives and the no-match rule dies. The E-Verify contractor rule and the no-match rules were released in the tail end of the Bush Administration. The E-Verify rule would require most major federal contractors to use E-Verify in order to qualify for their contracts. The no-match rule covered situations where employers received letters from the Social Security Administration notifying them that employees social security numbers do not match their names. The rule outlined specific procedures for employers to follow after receiving such letters and the penalty for not following the procedures is a potential...

Hi Folks,
Just wanted to remind members we only have 4 days left until the deadline for the letter campaign for Administration Fixes!!! Please print out some copies of the template # 1 for example, and collect signatures and addresses from your friends and colleagues. They will support you and their signature can really help our numbers. We need big numbers if we are going to make an impact.
I read we have 26,000 members -it would be something wonderful if everyone took 5 minutes to do this. At the very least, do it for yourself and your family. I don't want us to fail this effort.

11,100 H-1B visas remain of the 65,000 quota with 1500 more claimed over the last week. That's a moderate increase from the roughly 1200 used weekly over the last month. I'm pushing my exhaustion target up a week. The master's cap of 20,000 will be reached sometime this week, almost exactly the date I predicted several months ago. The 400 visas claimed weekly in this category will presumably shift to the general H-1B cap and that could accelerate depletion of those visas. That being the case, we could very well see the cap reached next month.

FP has nothing to do with the EAD or AP.
It is a security check as part of 485 processing where you are checked for a criminal background.

I'm surprised no organization is following up with USCIS about the prompt monthly updates on pending Volumes. So much for the push for openess during the 90 day initiative by the President !
Going by the charts and Dashboard one would come to think the September volumes has whittled down to Zero !! Hmmm..

don't think their is a set time required. I know people that left their employer the day after gc arrived, know people that left 6 months after their approval and some that have worked for their employer even after receiving their green card for over 4 years. hope this helps

Case against his employer had held in the past year and he was doing right to get his right to get the money back so he was not doing anything wrong in the past with his employer but how the new employer of his company react on that background and understand is totally depends upon them but don't worry about it, he was not wrong.

My Situation:
I am on H1B visa and working now with employer A (from Jun 10 to Till Date)
I was working with employer B (from Jun 09 to Jun 10)
I was previously also working with employer A (which is now my present employer) from Jul 08 to Mar 09,
My H1 Transfer from employer B to A has been filed in last Jun 10 but it is in Process now.
Now my present project is over, I have got a project with employer C
My Questions:
1. Can I join the employer C by filing another H1 transfer? as of now still my H1 Transfer (employer B to employer A) is in process.
2. I have also got another project with my ex employer B, I can see the I797 petition of the employer B is still showing a status of approved in the USCIS state, it has not been reoked. Can I rejoin the ex employer B without filing any new H1 Transfer ( from employer A to employer B).
Will appreciate your answer,
Thanks,
Nagari

You can apply again if you have a new employer, or even if the same employer will reapply. However, if you were denied for a reason that is still a problem, such as not having the required degree or experience equivalent, there is no point in reapplying. Good luck.

It's too late. BEC already cleared 80% of the cases by now. Only 40000 cases left in BEC as per Oh.
