    If one has EB1 (Extraordinary Ability) Pending, is one allowed to stay in the US until the case is decided? I know it may takes at least an year for the final approval...

    I haven't been following the news latetly.
    Last year .. the h1 visas got filled on Oct 1st .. the day it opened.
    Any idea what the status is this year?
    If i need to apply for someone's fresh h1 visa, when can I do it?

    It would be very tough to get CP appointment before the end of July. So I am not even thinking of CP. Also CP needs to be approved when your PD is current.

    Hi,
    My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?

    - My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?

    - Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

    When I was on F1, I was able to get my EAD by going to USCIS office. Not sure if we can do the same thing after filing I-485

    I applied I-140 in EB2 NIW category. I need to apply for H1 extension as this is my 5th year. I need to talk to my employer.

    I see because of retrogression one cannot file for I-485.

    Can I file for extension of H1 after I get I-140 approval or do I have to wait for I-1485 filing.

    Please advise.

    I had my I-485 interview at Boston-CIS in May,2007 and since then they were telling me lots of BS like NC, One security check open, additional review. Finally they sent me a letter telling me I need to attend NSEER interview at ICE office in Boston and I did that this week and the nice ICE officer told me that he was sending my file back to NSC. Last time I saw that thick file was when I was interviewed by IO at Boston-CIS!. Does it mean NSC will approve it now? I'm EB2 ROW and I was never finger printed more than once. So far had 2 EAD/AP and I applied in 2006 August

    While we all sit and wait in this painful 485 retrogression, I am just wondering, what if the retrogression pulls on past the 3 year extension (attained after the initial 6 years and I140 approval).

    I have my perm LC/I140 approved/485 retrogressed with a PD of Feb 2006.
    Being EB2 and starting my 7/8/9 years in early 2007, I am a bit unlikely to hit that scenerio, but someone like me in EB3 is very likely to hit that scenerio...

    Does anyone know, what happens after 9 years on H1 and not able to file 485 due to retrogression??

    22 Democratic Senators are urging President Obama to stop deporting young people who are likely to be eligible for legalization if the DREAM Act passes. The White House has so far rebuffed such requests with the not very believable excuse that it's hands are tied. That's simply not so and the President's executive authority to solve immigration problems Congress is ignoring has been well documented. Hopefully, the pressure will start to pay off.
